What is a Personal Injury Claim?

The term “personal injury” refers to an area of the law that lets you get a legal remedy for all losses stemming from an accident or other incident where someone else’s carelessness or intentional conduct caused you to be injured.

A personal injury case is a civil action, meaning that when some other person or a business is found to be legally responsible (at fault) for causing your injuries, the remedy comes in the form of damages -- money that is paid by the liable party (the defendant) to the injured party (the plaintiff). Compare this with criminal liability, where the person who has committed the wrong will be subject to sanctions like imprisonment, fines, and community service if they are prosecuted and convicted in criminal court.

FAQs

Hi there! Have some questions about Personal Injury Claim? Find the answers below.
  • PROCESS

Our partner solicitors can assess the details of your claim and will advise you as to whether you have a case to be compensated for your injuries.

Should you decide to seek our service and represent you on your claim, our advisers will assist you in the next process. You’ll then enter into an agreement with your solicitor who will be acting on your behalf to make your claim. They will then file a letter of claim to the person responsible for causing your accident (the defendant).

  • TIME SPENT

The length of time it will take to make your claim depends on your case.

Every case is different, so it’s very difficult to say at the early stages how long the process will be from start to finish. You could contact one of our advisers to discuss your situation.

  • FEES & CHARGES

A No Win No Fee arrangement – which is also known as a contingency or conditional fee agreement (CFA) – is an agreement between yourself and your solicitor that ensures you don’t need to worry about paying for upfront legal fees.

We offer No Win No Fee on personal injury claims.

  • RECENCY

In most cases, the amount of time you have to seek compensation is three years from the date the accident occurred. So if your accident took place a few years ago, you may still be able to claim.

  • OTHER LOSSES

You may be entitled to compensation for losses other than your personal injury. Claims are split into two parts: general damages and special damages.

General damages are the compensation paid for the pain and suffering and emotional distress from your physical injury, whereas special damages relate to damaged belongings or financial losses resulting from the injury.
